California’s coronavirus guidelines are consistently altering, lawsuits are being filed
California’s businesses are grappling with the state’s ever-changing COVID guidelines.
Various California companies have joined the fight against the governor’s ban on outdoor dining. The Pineapple Saloon, a restaurant in Sherman Oaks, went viral after the owner posted a video of a Hollywood production team setting up catering just yards from her while her restaurant was forced to remain closed. She filed a complaint against the governor invoking his executive ordinances and “the state’s enforcement of these rules violates substantive and procedural rights protected by the procedural clauses of the fifth and fourteenth amendments”.
Now others are joining the fight, and Dhillon Law Group, Inc. and Geragos & Geragos have filed an amended complaint that encompasses more than just the restaurant industry. Pineapple Saloon v Newsom added new plaintiffs Images Images Luxury Nail Lounge, Inc., POMP Salon, Bella & Harmony, Inc. and Coachella Valley Hospitality Unites.
“Cutting hair and eating outdoors are criminal acts in only one state in the United States, as Governor Newsom decided to turn these industries into sacrificial lambs,” said Fred Jones, general counsel for the Professional Beauty Federation of California.

Many restaurateurs say the ban on eating outside actually contributed to an increase in the number of coronavirus cases by forcing the ban on indoor eating to be lifted and people gathering outside rather than outside. In states like California, which is bright and sunny for most of the year, there is no point forcing people to stop congregating outside.
“This is not a brain operation. We were misled by the health officials. You dont know what you are doing; it was demonstrated over and over again. They are the ones who cause death by forcing people indoors, “said lawyer and restaurant owner Mark Geragos.
“The reality is that a ban on indoor and outdoor dining is driving people indoors into their own private homes. There is clearly an increased risk of transmitting COVID. You will not have the procedures in place to prevent the transmission of COVID in a restaurant, ”agreed Robert Winters, an infectious disease specialist, who said the rules are confusing.
“There is no scientific evidence or data to justify the blanket closure of all outdoor restaurants and beauty services,” said Harmeet K. Dhillon, managing partner of Dhillon Law Group, Inc.
Meanwhile, San Francisco Mayor London Breed recently announced that the city would slowly begin reopening stores in part to prove that the rules are constantly changing and the much anticipated announcement at a public press conference close. Breed warned that opening things up too quickly and forgetting the Centers for Disease Control and Prevention’s safety procedures could easily be a recipe for disaster.
“Just remember, this is not an open door for us to suddenly let our hair fall and do what we want,” said Breed. “Let’s keep doing what we do. Let’s continue to be smart about how we wear our mask and who we interact with. Let’s limit the number of people we interact with so we can make sure we don’t see any further rise and that this fire continues to spiral out of control. “
