Stephen Miller’s America First Legal Accuses Biden Administration of Racial Discrimination
The lawsuit alleges that the terms of the Restaurant Revitalization Fund are biased against men and whites.
America First Legal, a conservative advocacy group founded by former Trump adviser Stephen Miller, has filed another lawsuit against the Biden administration, this time for racial discrimination in the distribution of coronavirus aid funds.
According to The Hill, the lawsuit specifically concerns the Small Business Administration’s treatment of $ 28.6 billion from the Restaurant Revitalization Fund, which is part of President Biden’s US rescue plan.
America First Legal claims that the fund’s terms require the SBA to “discriminate between restaurants based on race and gender of the owner” by requiring Small Business Administration officials to “prioritize grants to restaurants owned by women and minorities “.
This prioritization should be done for the first 21 days of reviews and awards.

“These racial and gender preferences are manifestly unconstitutional and the Court should require their enforcement immediately. This will promote equal rights for all American citizens under the law and encourage efforts to end racial discrimination, ”the lawsuit reads.
Miller himself has explicitly accused the federal government of practicing discrimination through these policies.
“Few industries are more affected by lockdowns and restrictions than the restaurant and bar industry,” Miller said in a statement earlier this week.
“But as these restaurant owners, operators and workers try to pick up the pieces and rebuild their businesses, they face a new and insidious threat: racial discrimination by the government,” he added. “[This] The Biden administration’s decision to determine eligibility and priority for restaurant aid funds based on race is deeply illegal and morally outrageous. “
The Hill notes that women, veterans, and socially and economically underprivileged groups have already applied for approximately $ 29 billion in grants through various SBA programs and grants.
The lawsuit is astonishingly similar to another that America First Legal filed in April.
In this complaint, Miller’s group questioned another aspect of the US rescue plan, which provides assistance to “socially disadvantaged farmers and ranchers”.
“The Department of Agriculture interprets this term to include African American, Hispanic, American Indian, Alaskan native, Asian American and Pacific islander,” the lawsuit said. “But white farmers and ranchers are not included in the definition of” socially disadvantaged farmers and ranchers, “so they are not eligible for assistance under these federal programs.”
America First Legal has also filed a lawsuit against the Biden government’s decision to deport all asylum seekers detained at the US-Mexico border because that decision included an exemption for children. Miller wanted everyone, regardless of age, to be sent back across the border.
